We do not screen content uploaded onto ScholarLMS, but we have the right (but not the obligation) in our sole discretion to refuse or remove any content that is available via the Service that we deem inappropriate, illegal, offensive, threatening, libellous, defamatory, pornographic, obscene, or otherwise objectionable or violate any party’s Intellectual Property Rights or this Agreement. We have the discretion (but not obligation) to terminate a Customer’s access to and use of the Services if, we determine that Customer or its Authorised Users are repeat infringer of the Intellectual Property Rights of us or third parties.
Content Ownership
1. You will retain all Intellectual Property rights over data (course content, files, user information, profile, etc) uploaded by you in your ScholarLMS account under this Agreement. ScholarLMS will not publicly disclose any Customer-specific information but may disclose aggregated and de-identified customer information related to the Services for promotional purposes, such as project summary and high-level outcomes of the Services.
2. If you provide us with ideas, comments or suggestions relating to the Service or Underlying Systems(together feedback):
a) all Intellectual Property Rights in that feedback, and anything created as a result of that feedback (including new material, enhancements, modifications or derivative works), are owned solely by us; and
b) we may use or disclose the feedback for any purpose.

Our Website may contain links to third party websites. These links are provided solely as a convenience to you. By linking to these websites, we do not create or have an affiliation with, or sponsor such third party websites. The inclusion of links within our Website does not constitute any endorsement, guarantee, warranty, or recommendation of such third party websites. General Terms
Our Legal Terms shall be treated as though it were executed and performed in Uttrakhand, India and shall be governed by and construed in accordance with the laws of Uttarakhand, India without regard to conflict of law principles. In addition, you agree to submit to the personal jurisdiction and venue of such courts. Any cause of action by you with respect to our Website, must be instituted within one (1) year after the cause of action arose or be forever waived and barred. Should any part of our Legal Terms be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that any Content in our Website conflicts or is inconsistent with our Legal Terms, our Legal Terms shall take precedence. Limited License
You understand and agree that your use of our website is limited and non-exclusive as a revocable licensee. We may terminate your license to use our website, and access to our website, for any reason, and without giving you notice.
Account License
All customer accounts are for private use only. No account sharing or reselling is allowed. Violation of these conditions could have your account terminated without any refund.
Automatic Account Deletion
We encourage our users to actively log in and use ScholarLMS when they register an account with us. To maintain security, limit data retention, and protect the privacy of our users, ScholarLMS accounts are timely flagged as “inactive” account. Our system flags an account “inactive” if:
1. You have not reset your account’s password within first 30 days. OR
2. Not logged-in by you or any of your users for 90 days.
To keep your account active, be sure to log in to the system at least once in every 90 days. We send alerts (email notifications) if your account goes inactive for 90 days. The final email confirmation about account deletion goes 24hrs before the system actually permanently removes your account.
Please note, the account deletion policy is applies only to free plan (Startup Plan) users.
Fair Usage Policy
At ScholarLMS, we strive to provide our valued customers with a platform that encourages the creation and sharing of educational content. To ensure that our services are accessible and reliable for all users, we have established this Fair Usage Policy. This policy outlines the responsible use of our unlimited disk space limit and aims to prevent misuse that could impact the quality of service for others.
1. Purpose of Unlimited Disk Space
Our unlimited disk space is designed to accommodate the storage needs of legitimate users for their educational content. This includes course materials, videos, documents, and associated resources. It is not intended for purposes other than educational content hosting within the ScholarLMS platform.
2. Prohibited Activities
To maintain a fair and reliable environment for all users, the following activities are strictly prohibited:

- Bulk Media Storage: Uploading or storing excessive amounts of non-educational media files, such as personal videos, music, or unrelated multimedia content.
- File Backup: Using ScholarLMS as a primary or secondary backup solution for personal or non-educational files.
- Data Mining: Engaging in data mining, scraping, or any activity that places an undue burden on our infrastructure or violates our terms of service.
- Malicious Content: Uploading, storing, or distributing any malicious or harmful content, including viruses, malware, or content promoting hate, violence, or discrimination.
- Unauthorized Access: Attempting to gain unauthorized access to any part of the ScholarLMS system, other users’ accounts, or restricted content.
- Phishing or Fraud: Conducting phishing schemes, fraud, or any activities designed to deceive or defraud other users or the system.
- Spamming: Sending unsolicited bulk messages, advertisements, or promotions using ScholarLMS communication tools.
- Copyright Infringement: Uploading or distributing content that violates copyright laws or infringes on intellectual property rights.
- Impersonation: Falsely representing oneself as another user, administrator, or entity within ScholarLMS.
- Disruptive Behavior: Engaging in any actions that disrupt the normal operation of the ScholarLMS platform or the learning environment for other users.
3. Monitoring and Enforcement
ScholarLMS reserves the right to monitor account usage and assess compliance with this Fair Usage Policy. In cases of suspected misuse, we may take the following actions:
a) Warning: We may issue a warning to the user, advising them to modify their usage to comply with the policy.
b) Limitations: In cases of persistent misuse, we may place limitations on the account’s storage capacity or access to specific features until compliance is achieved.
c) Account Suspension or Termination: In extreme cases of repeated or severe violations, ScholarLMS may suspend or terminate the user’s account.
